Cortez Law Firm, PLLC represents businesses that have “business interruption” insurance coverage and have been forced to suspend and/or severely limit operations as a result of the Covid-19 pandemic. This includes bars, restaurants, retail and hospitality businesses as well as other businesses deemed “non-essential” including certain professional practices like dental and chiropractic clinics.
“Business Interruption” Insurance ( also sometimes referred to as “Business Income”) provides coverage for loss of income (and some expenses) when businesses are forced to suspend operations.
Not surprisingly, most insurance companies are denying these claims and taking the position that insurance coverage only applies if there is physical damage to the premises- (like a tornado or fire). Insurance companies are ignoring important policy language that states coverage is provided if there is a “physical loss of” the premises… not just physical damage.
Note, some businesses have other policies or coverages which are independent of these issues. These include “Restaurant Recovery” policies and “Pandemic event coverages”.
